Legal professional Normal Garland built it distinct in the DOJ indictment of Bannon that government privilege belongs to the Executive Branch, not Trump.

Web site two of the Bannon indictment spells this out, “STEPHEN K. BANNON was a personal citizen. For about seven months in 2017, far more than 3 a long time before the gatherings of January 6, 2021, BANNON was utilized in the Executive Branch of the U.S. Governing administration as the Chief Strategist and Counselor to the 2 to: President. Following departing the White Dwelling in 2017, BANNON did not function yet again in any Govt Department or federal federal government position.”

The DOJ never had to point out Trump or Biden or relationship with executive privilege. The DOJ is arguing that govt privilege rests with the Govt Branch, which means that the recent head of the Govt Department, President Biden, is the man or woman with the authority to use govt privilege.

As Laurence Tribe put it on Twitter:

DOJ is rightly indicating executive privilege belongs not to any person but to the executive department, of which the one and only president is the head. His title is Biden, not Trump. https://t.co/yp1yIpaCMz

The DOJ didn’t break with any former statements on govt privilege, but by criminally indicting Steve Bannon and placing executive privilege power with the Government Branch, the message is extremely very clear. Donald Trump has no government privilege.
